Special Needs Trust Fairness Act Reintroduced in Congress

After falling short in the previous Congress, Congressmen Glenn 'GT' Thompson and Frank Pallone, Jr. recently introduced the Special Needs Trust Fairness Act of 2015, a bill designed to make it easier for people with special needs to create their own first-party special needs trusts . The current law governing first-party special needs trusts states that a trust must be created by the beneficiary's parent, grandparent, or guardian or by a court, even if the beneficiary is mentally competent.
